We, the Institut Bauen und Umwelt e.V. (IBU), Hegelplatz 1, 10117 Berlin, are the operators of this website and the services offered on it. Data protection is particularly important to us. It is generally possible to use the IBU website without providing any personal data. However, if a data subject wishes to use special services via our website, it may be necessary to process personal data. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.

The processing of personal data, such as the name, address, email address, or telephone number of a data subject, is always carried out in accordance with the General Data Protection Regulation and in compliance with the country-specific data protection regulations applicable to us. With this privacy policy, we would like to inform users of our website about the type, scope, and purpose of the personal data we collect, use, and process. Furthermore, this privacy policy informs data subjects of their rights.

As the controller, Institut Bauen und Umwelt e.V. has implemented numerous technical and organizational measures to ensure the most complete protection possible of the personal data processed via this website. Nevertheless, Internet-based data transmissions can generally have security gaps, so that absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, for example by telephone or post.

1. Definitions

The privacy policy of the Institut Bauen und Umwelt e.V. is based on the terminology used by the European legislators and regulators when enacting the General Data Protection Regulation (GDPR). Our privacy policy is intended to be easy to read and understand for the public as well as for our members and business partners. To ensure this, we would like to explain the terms used in advance.

We use the following terms, among others, in this privacy policy:

a) Personal data

Personal data is any information relating to an identified or identifiable natural person (hereinafter referred to as “data subject”). A natural person is considered identifiable if they can be identified directly or indirectly, in particular by association with an identifier such as a name, an identification number, location data, an online identifier, or one or more special characteristics that express the physical, physiological, genetic, psychological, economic, cultural, or social identity of that natural person.

b) Data subject

A data subject is any identified or identifiable natural person whose personal data is processed by the controller.

c) Processing

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, distribution, or otherwise making available, alignment or combination, restriction, erasure, or destruction.

d) Restriction of processing

Restriction of processing is the marking of stored personal data with the aim of limiting their processing in the future.

e) Controller or processor

The controller or processor is the natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

f) Processor

A processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

g) Recipient

A recipient is a natural or legal person, public authority, agency, or other body to which personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.

h) Third party

A third party is a natural or legal person, public authority, agency or another body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.

i) Consent

Consent is any freely given, specific, informed, and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

2. Name and address of the controller

The controller within the meaning of the General Data Protection Regulation, other data protection laws applicable in the Member States of the European Union, and other provisions of a data protection nature is:

3. What data is logged when I visit the IBU website?

Every time a user accesses a page on our website and every time a file is retrieved, access data about this process is stored in a log file on our server:

IP address of the requesting computer

Website from which the file was requested

Date and time of access

Browser type and browser settings

Operating system

The page you visited

Amount of data transferred

Access status (file transferred, file not found, etc.)

When using this general data and information, the IBU does not draw any conclusions about the person concerned. Rather, this information is required in order to (1) deliver the content of our website correctly, (2) optimize the content of our website, (3) ensure the long-term functionality of our information technology systems and the technology of our website, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack. This anonymously collected data and information is therefore evaluated by the IBU on the one hand statistically and on the other hand with the aim of increasing data protection and data security in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data in the server log files is stored separately from all personal data provided by a data subject.

4. Contact option via the website https://ibu-epd.com/kontakt/

Due to legal requirements, the IBU website contains information that enables quick electronic contact with us and direct communication with us, which also includes a general address for so-called electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted voluntarily by a data subject to the controller is stored for the purpose of processing or contacting the data subject. This personal data is not passed on to third parties.

5. Routine deletion and blocking of personal data

The controller processes and stores the personal data of the data subject only for the period necessary to achieve the purpose of storage or if this has been provided for by the European legislator or another legislator in laws or regulations to which the controller is subject.

If the purpose of storage no longer applies or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.

6. Subscription to our newsletter

On the IBU website, users are given the opportunity to subscribe to a newsletter. The personal data transmitted to the controller when ordering the newsletter is determined by the input mask used for this purpose.

The IBU newsletter can only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for the newsletter. For legal reasons, a confirmation email is sent to the email address entered by a data subject for the first time for the newsletter dispatch in a double opt-in procedure. This confirmation email serves to verify that the owner of the email address has authorized the receipt of the newsletter as the data subject.

When registering for the newsletter, we also store the IP address assigned by the Internet service provider (ISP) to the computer system used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary in order to be able to trace any (possible) misuse of the email address of a data subject at a later date and therefore serves to provide legal protection for the controller.

The personal data collected in the context of a newsletter subscription is used exclusively for sending our newsletter. Furthermore, subscribers to the newsletter may be informed by email if this is necessary for the operation of the newsletter service or a related registration, as may be the case in the event of changes to the newsletter offer or changes to the technical conditions. The personal data collected as part of the newsletter service will not be passed on to third parties. The data subject can unsubscribe from our newsletter at any time. The consent to the storage of personal data that the data subject has given us for the purpose of sending the newsletter can be revoked at any time. For the purpose of revoking consent, a corresponding link is provided in each newsletter. Furthermore, it is also possible to unsubscribe from the newsletter at any time directly on the website of the controller or to notify the controller in another way.

7. Registration for the IBU member area; registration with IBU.data; rejection of registration

7.1 IBU member area

Registration in the IBU member area is exclusively permitted to its members.

The following personal data is required to register in the member area:

Once you have entered the required information during registration, confirm by clicking on “Register.” Your data will then be stored in a user administration system. However, it will only be released by an authorized IBU employee after your membership has been verified.

7.2 IBU.data

On IBU.data, the Institut Bauen und Umwelt e.V. (Institute for Construction and the Environment) provides the life cycle assessment-based data from the Environmental Product Declarations (EPDs) of construction products in digital form as XML files based on the ILCD format for download. Registration is only necessary here in order to download the data provided. The data can also be viewed without registration.

The following personal data is required to register with IBU.data:

Once you have entered the required information during registration, confirm it by clicking on “Register.” Your data will then be stored in a user administration system. However, approval will only be granted by an authorized IBU employee.

7.3 Rejection of registration

If you have registered for the member area and/or to download from IBU.data, but approval has been rejected by the IBU for legitimate reasons, the affected stored profiles will be deleted immediately or without delay in the course of the rejection.

8. Rights of the data subject

a) Right to confirmation

Every data subject has the right granted by the European Directive and Regulation to request confirmation from the controller as to whether personal data concerning them is being processed. If a data subject wishes to exercise this right of confirmation, they can contact an IBU employee at any time.

b) Right to information

Every person affected by the processing of personal data has the right granted by the European Directive and Regulation to obtain, at any time and free of charge, information from the controller about the personal data stored about them and a copy of this information. Furthermore, the European Directive and Regulation grants the data subject the right to information about the following:

the purposes of the processing

the categories of personal data that are being processed

the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations

where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period

the existence of a right to rectification or erasure of personal data concerning them or to restriction of processing by the controller or a right to object to such processing

the existence of a right to lodge a complaint with a supervisory authority

if the personal data are not collected from the data subject: All available information on the origin of the data

the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) of the GDPR and, at least in these cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject

Furthermore, the data subject has the right to obtain information as to whether personal data has been transferred to a third country or to an international organization. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards in connection with the transfer.

If a data subject wishes to exercise this right of access, they may contact an IBU employee at any time.

c) Right to rectification

Every data subject affected by the processing of personal data has the right, granted by the European legislator, to request the immediate rectification of inaccurate personal data concerning them. Furthermore, the data subject has the right, taking into account the purposes of the processing, to request the completion of incomplete personal data, including by means of a supplementary statement.

If a data subject wishes to exercise this right of rectification, they may contact an IBU employee at any time.

d) Right to erasure (right to be forgotten)

Every person affected by the processing of personal data has the right granted by the European legislator to request that the controller delete personal data concerning them without delay, provided that one of the following reasons applies and insofar as the processing is not necessary:

The personal data has been collected or otherwise processed for purposes for which it is no longer necessary.

The data subject withdraws their consent on which the processing was based in accordance with Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, and there is no other legal basis for the processing.

The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.

The personal data has been processed unlawfully.

The erasure of the personal data is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.

The personal data has been collected in relation to information society services offered in accordance with Art. 8(1) GDPR.

If one of the above reasons applies and a data subject wishes to have personal data stored by the IBU deleted, they can contact an IBU employee at any time. The IBU will ensure that the request for deletion is complied with immediately.

e) Right to restriction of processing

Any person affected by the processing of personal data has the right granted by the European legislator to request the controller to restrict processing if one of the following conditions is met:

The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.

The processing is unlawful, the data subject refuses to have the personal data deleted and instead requests the restriction of the use of the personal data.

The controller no longer needs the personal data for the purposes of the processing, but the data subject needs it to assert, exercise or defend legal claims.

The data subject has objected to the processing pursuant to Art. 21 (1) GDPR and it is not yet clear whether the legitimate reasons of the controller outweigh those of the data subject.

If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored by us, they may contact an employee of the controller at any time. The IBU will arrange for the restriction of processing.

f) Right to data portability

Every data subject affected by the processing of personal data has the right, granted by the European legislator, to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used and machine-readable format. They also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. Furthermore, when exercising their right to data portability pursuant to Art. 20(1) GDPR, the data subject has the right to obtain the transfer of the personal data directly from one controller to another controller.

Furthermore, when exercising their right to data portability pursuant to Art. 20(1) GDPR, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of others.

To assert the right to data portability, the data subject may contact an IBU employee at any time.

g) Right to object

Any person affected by the processing of personal data has the right granted by the European legislator to object, on grounds relating to their particular situation, at any time to the processing of personal data concerning them which is based on Article 6(1)(e) or (f) of the GDPR.

In the event of an objection, the IBU will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or the processing serves to assert, exercise, or defend legal claims.

To exercise the right to object, the data subject may contact an IBU employee directly. Furthermore, in connection with the use of information society services, the data subject is free to exercise their right to object by means of automated procedures using technical specifications, notwithstanding Directive 2002/58/EC.

h) Right to revoke consent under data protection law

Every person affected by the processing of personal data has the right, granted by the European legislator, to revoke consent to the processing of personal data at any time.

If the data subject wishes to exercise their right to revoke consent, they can contact an IBU employee at any time.

9. Duration for which personal data is stored

The criterion for the duration of the storage of personal data is the respective statutory retention period. After expiry of this period, the corresponding data is routinely deleted, provided that it is no longer required for the fulfillment of a contract or the initiation of a contract.

10. Cookies

We use session cookies on our website. The data is not stored permanently. The use of temporary cookies offers you the advantage that you do not have to enter your personal data repeatedly when filling out various forms on our website: The cookies are automatically deleted when you close your browser.

Cookies do not damage your computer's hard drive, nor are any personal data transmitted to us when cookies are set.

Most browsers are set to automatically accept cookies. However, you can deactivate the storage of cookies or set your browser to notify you as soon as cookies are sent.

If you have deactivated cookies, a so-called session ID is used to identify a person during a continuous visit to our website. No data is stored on your computer. The session ID is deleted after you end your visit.

11. Web analysis service Google Analytics

This website uses Google Analytics, a web analysis service provided by Google Inc. (“Google”). Google Analytics uses so-called “cookies” (see point 10), text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of our website, such as

browser type/version;

operating system used;

referrer URL (the previously visited page);

host name of the accessing computer (IP address), and

time of the server request

is usually transmitted to a Google server in the USA and stored there. We have activated IP anonymization. On this website, your IP address will therefore be truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area.

Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage to the website operator.

The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. You may refuse the use of cookies by selecting the appropriate settings on your browser software; however, please note that if you do this, you may not be able to use the full functionality of this website.

12. Transfer of personal data to third parties

We only use personal data for internal purposes in the course of the customer relationship. It will not be passed on to third parties without your necessary consent.

Personal data is only collected and transferred to government institutions and authorities entitled to receive such information within the framework of the relevant laws or if we are obliged to do so by court order. All employees and service providers are bound by us to maintain confidentiality and comply with data protection regulations. This will also be the case for future employees or business partners.
